These Terms are provided in a format that can be stored and reproduced. A downloadable PDF copy is available upon request.
2. Definitions
Consumer
An individual acting for purposes wholly or mainly outside their trade, business, craft, or profession.
Business Customer
Any customer that does not meet the definition of a Consumer.
Services
Hosting services provided by Robotic Node LTD including but not limited to VPS hosting, dedicated servers, game hosting, and managed infrastructure services.
Material Change
A change affecting pricing, refund rights, dispute resolution forums, liability limits, or the scope of the Acceptable Use Policy.
Force Majeure
Events beyond reasonable control including but not limited to natural disasters, war, terrorism, civil unrest, government actions, labour disputes, power failures, upstream network outages, or large-scale cyberattacks.
3. Acceptance & Contract Formation
A legally binding contract is formed when we accept payment for a Service.
By completing checkout and selecting the acceptance checkbox, you confirm that you have read and agreed to these Terms.
Provisioning of the Service constitutes the commencement of performance under the contract.
We maintain versioned records of the Terms applicable at the time of purchase.
You must be at least 18 years old, or have permission from a parent or legal guardian, to purchase Services.
4. Changes to Terms
We may update these Terms for the following reasons:
- Compliance with legal or regulatory obligations
- Security or infrastructure improvements
- Changes to service models or technology
- Clarification of existing provisions
- Pricing adjustments
For any Material Change we will provide:
- At least 30 days' prior notice by email
- A clear summary of the changes
- The right to cancel before the effective date without penalty
- A refund of unused prepaid service periods
Continued use of the Service after the effective date constitutes acceptance.
Administrative or non-material updates may take effect immediately.
5. Service Standards
5.1 Reasonable Care
Services are provided with reasonable care and skill consistent with industry standards.
Nothing in these Terms limits statutory rights available to Consumers under applicable law.
Service availability commitments and any applicable service credits are governed exclusively by our separate Service Level Agreement (SLA).
5.2 Infrastructure Protection
To maintain service stability and network security we may implement traffic filtering, rate limiting, service isolation, or other technical restrictions where reasonably necessary.
5.3 Backups
Backups provided as part of any Service are offered on a reasonable-efforts basis and are not guaranteed to be complete, accurate, or recoverable.
Customers remain responsible for maintaining independent copies of all critical data.
6. Consumer Cancellation Rights
If you are a Consumer purchasing remotely, you have the right to cancel within 14 days of contract formation.
Where you request immediate provisioning:
- You expressly request that we begin performance of the Service during the 14-day cancellation period.
- You acknowledge that you must pay proportionally for Services supplied until cancellation.
- If the Service is fully performed within the 14-day period, your cancellation right ends.
We retain durable records of this consent.
7. Fees & Payments
7.1 Prepayment
All Services are prepaid unless otherwise agreed.
Accounts overdue may be handled as follows:
- 3 days overdue: Service suspension
- 7 days overdue: Service termination
Following termination, service data may be retained for a limited recovery period at our discretion. After this period data may be permanently deleted and cannot be recovered.
7.2 Late Payment)
Late payments may accrue interest at a rate of 8% per annum above the Bank of England base rate, calculated daily from the due date until payment is received in full.
For Business Customers, this clause is in addition to any rights available under the Late Payment of Commercial Debts (Interest) Act 1998.
7.3 Refund Policy
48-Hour Technical Guarantee
If a Service materially fails to meet the advertised technical specifications at the time of purchase, a refund may be requested within 48 hours. A material failure means a verified inability of the Service to provide the core technical resources advertised, including CPU allocation, RAM allocation, storage capacity, or network connectivity.
Dedicated Servers & Setup Fees
Dedicated server provisioning and setup fees are non-refundable except where:
- We fail to provide the Service as described
- Refund is required by law
AUP-Related Termination Refunds
If Services are terminated due to serious breach of the Acceptable Use Policy:
- No refund is issued for service periods already supplied
- No refund applies to direct costs incurred due to the breach
For non-serious breaches, unused prepaid periods may be refunded on a pro-rata basis.
8. Acceptable Use Policy
Services must not be used for:
- Illegal activity
- Crypto Mining or unauthorized cryptocurrency activities
- AI model training
- Malware distribution, botnets, or phishing
- DDoS attacks or IP spoofing
- Copyright infringement
- Spam or unsolicited bulk email
- Fraud or impersonation
- Illegal Pornographic content
8.1 Enforcement
Minor Breach: Warning, suspension, remediation
Serious Breach: Immediate suspension
Repeated Breach: Termination
Serious breaches include malware hosting, participation in DDoS attacks, fraud, or criminal activity. Enforcement decisions are proportionate and documented.
We may investigate potential abuse and may access relevant service data where reasonably necessary to enforce these Terms or comply with legal obligations.
9. Unmetered & Fair Use Policy
Where services are advertised as "Unmetered", this means there is no fixed numerical cap on usage but usage remains subject to reasonable operational limits. Unmetered does not represent infinite resource availability.
Bandwidth usage is measured using the 95th percentile method:
- Traffic sampled every 5 minutes
- Calculated across a rolling 30-day period
Sustained bandwidth exceeding 1 Gbps at the 95th percentile on shared infrastructure may trigger review.
Storage must relate to active hosting use and may not be used for bulk archival unrelated to service operation.
Before applying restrictions we will normally provide written notice and a 7-day remediation period unless an immediate risk to infrastructure exists.
10. Data Protection
Robotic Node LTD acts as Data Controller for:
- Account information
- Billing records
- IP logs
- KYC documentation (where SMTP access is requested)
Personal data is processed under the following lawful bases:
- Contract performance
- Legal obligations
- Legitimate interests including fraud prevention and network security
KYC information is collected only when necessary, stored securely, and retained only for as long as required.
Users may exercise rights under UK GDPR including: access, rectification, erasure, restriction of processing, and complaint to the Information Commissioner's Office (ICO). Further details are provided in our Privacy Policy.
11. Chargebacks
Customers should first attempt resolution through billing support before initiating a chargeback.
Where a chargeback occurs:
- The transaction will be investigated
- Account access may be temporarily restricted where reasonably necessary
Fraud reporting will only occur where there is credible evidence of fraudulent activity and in accordance with UK data protection law. Legitimate billing disputes are not treated as fraud.
12. Dispute Resolution
12.1 Internal Resolution
Disputes should first be raised with our support team.
12.2 Consumers
Consumers retain the right to bring claims before the courts of England and Wales. Arbitration may be used only where both parties agree after a dispute arises.
12.3 Business Customers
Business Customers agree that disputes may be resolved through the courts of England and Wales, or arbitration conducted in England under LCIA rules. Disputes shall be resolved either through the courts of England and Wales or arbitration under LCIA rules, as agreed between the parties.
13. Liability
Nothing in these Terms limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Statutory consumer rights
- Any liability that cannot be legally excluded
13.1 Consumers
Liability is limited to foreseeable loss arising directly from breach of contract. We are not liable for business losses, loss of profit, or loss of opportunity.
13.2 Business Customers
Total aggregate liability is limited to the greater of fees paid during the preceding three months, or £1,000. Indirect or consequential losses are excluded.
14. Intellectual Property & Copyright
Robotic Node LTD is not affiliated with Mojang AB or Discord Inc.
Copyright complaints should be sent to [email protected]. Requests must include:
- Identification of the copyrighted work
- Exact server location of the alleged infringement
- Contact details of the complainant
- A good-faith statement
Content may be suspended during investigation. Counter-notice procedures are available upon request.
15. Termination
We may terminate Services:
- For serious Acceptable Use Policy breaches
- For non-payment
- To comply with legal obligations
Where termination occurs without customer breach we will provide 30 days' notice and a pro-rata refund of unused prepaid service periods.
16. Force Majeure
We are not liable for delays or failure to perform obligations due to Force Majeure events beyond our reasonable control.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force.
18. Entire Agreement
These Terms constitute the entire agreement between the parties. Informal communications including Discord messages do not modify this agreement unless confirmed in writing by an authorised representative of Robotic Node LTD.
These Terms are governed by the laws of England and Wales.
